amandla.mobi is an independent community advocacy organisation which seeks to build a just and people-powered Mzansi (South Africa). These Terms of Service outline the conditions upon which you can use our website to create campaigns, sign campaigns and engage with fellow amandla.mobi members.  By signing up to join a campaign, becoming an organiser, creating a campaign on our website, joining an amandla.mobi group and opting in on our website, you signify that you accept these Terms of Service and agree to be bound by them. We reserve the right to remove any campaigns or comments that do not share the organisation’s values.

1. USING OUR WEBSITE

1.1 Our website is available for your personal and non-commercial use only. 

1.2. amandla.mobi does not endorse or authorise any campaigns or member-generated content on our website.

1.3. You must use our website in accordance with these Terms of Service only for lawful purposes and in a way that does not infringe on anyone’s rights or restrict or inhibit anyone’s use of our website.

1.4. You must not harvest or collect email addresses, mobile phone numbers or other personal information about other users of our website for the purpose of sending unsolicited commercial messages or for any other purpose.

1.5. We update and carry out maintenance on our website regularly, so we may have to suspend access, service, or functionality from time to time without notice. We will not be liable if, for any reason, our website is not available at any time or for any period of time.

1.6.  We own, are the licensee of, the intellectual property rights in the content of our website.

1.7. By using this website, you confirm that you are over 18 years of age. We do not knowingly process data of any person under the age of 18. If we come to discover, or have reason to believe, that you are Y and under and we are holding your personal information, we will delete that information within a reasonable period and withhold our services accordingly.

1.7.1.  Personal information is processed on the basis of an individual’s vital interests. Applicable law allows us to process personal information in emergencies (e.g., life or death).

1.7.2. You agree not to adapt, alter or create a derivative work from any of the content except for non-commercial personal or educational use. Any other use of the content requires the prior written permission of amandla.mobi with the organisation. , or any identified contributors acknowledged as the authors of the content.

2. PRIVACY POLICY

2.1. We process information about you in accordance with our privacy policy. By using the website and/or our mobile channels, you consent to such processing and warrant that all data you provide is accurate. 3. YOUR CONTENT

3.1. You warrant that all text, images and other content you post on our website, including on affiliated sites, is your original work and/or to the extent that your content includes any text, images or other content owned by a third party, you warrant that you are licensed to use and reproduce such content on our website and/or it is appropriately credited.

3.2. You understand and agree that we may, in our sole discretion and without notice, edit and/or remove any campaign you have created on our website or any of your content which we believe violates these Terms of Service or which is or may be offensive, illegal, defamatory, or infringe the rights, or threaten the safety, of others.

3.3. By submitting and posting your content on our website, you give amandla.mobi and our related body corporate a perpetual, irrevocable, worldwide, royalty-free and non-exclusive licence to use, modify, reproduce, publish, broadcast, communicate, display and distribute it in any format, using any medium, for the purpose of promoting your campaign.

3.4. We reserve the right to remove any user contribution or event for any reason. This is a decision we will strive to make fairly, but ultimately is a decision that is solely up to us to take.

4. CLOSING YOUR ACCOUNT

4.1. We may suspend or cancel your account, including any access to our mobile channels, if you fail to comply with your obligations under these Terms of Service.

4.2. If your account is suspended or closed for any reason, you will not have access to the account (including your content).

4.3. The amandla.mobi team will determine, at its discretion, whether there has been a breach of these Terms of Service through your use of the site. When a breach has occurred, we may take such action as we deem appropriate, including but not limited to the following:

4.3.1. Immediate, temporary or permanent withdrawal of your right to use the amandla.mobi website;

4.3.2. Your immediate, temporary or permanent expulsion from any mobile channels of which you are a member;

4.3.3. immediate, temporary or permanent removal of any posting or material uploaded by you to the site or

4.3.4. legal proceedings against you for reimbursement of all costs on an indemnity basis resulting from the breach.

5. LIABILITY

5.1. You use the amandla.mobi website at your sole risk.

5.2. We provide our website on an “as is” basis. We do not represent or warrant that the operation of our website will be secure, confidential, uninterrupted, error-free, accurate, complete or current.

5.3. Except where we are unable to exclude our liability by law, we will not be liable to you for any loss or damage arising out of, or in connection with, your use of (including inability to use) our website.

5.4. We exclude liability for any loss of profit, loss or corruption of data, special, exemplary, punitive, incidental, indirect or consequential loss or damages suffered or incurred or arising in connection with our website or in connection with any act or omission by us.

5.5. We are not responsible to you for any liability, actions, claim, injury, loss or damage you suffer or incur relating to or in connection with your membership or your participation in any activities organised or instigated by amandla.mobi.

5.6. The names, images and logos identifying amandla.mobi or any other third parties referred to on the website and/or our mobile channels and their products and services may be subject to copyright, design rights or trade mark rights. These trademarks may not be reproduced without the consent of the relevant owners. Nothing contained in these terms of service shall be construed as conferring any licence or right to use any trademark, design right or copyright of amandla.mobi or any other third party.

6. LINKS TO THIRD PARTY SITES AND RESOURCES

6.1.  Our website may contain links to third-party sites and resources. We have no control over those sites and will not be liable for any loss or damage you suffer or incur when you use a third-party site or resource.

6.2. We do not allow links to third-party petition sites in our petitions or emails that you send to your petition signers. This confuses people and is often counterproductive. We reserve the right to remove or edit petitions and delete or edit emails that link to third-party petitions in breach of this term.

7. ONLINE DONATIONS

7.1. Acceptance of online donations: amandla.mobi accepts online donations via a third-party platform, GivenGain using an online donation form. Donors can make a single or monthly donation to amandla.mobi here.   

7.2. Donor privacy policy: amandla.mobi shall take all reasonable steps to protect the personal information of all members and users in line with our privacy policy. However, as per our donation policy, for any donation over R10,000, we publish the source in our Annual Financial Statement and on our website.  

7.3. Tax receipt: amandla.mobi issues electronic tax certificates (Section 18A certificates) at the end of each year. Donations with a total donation amount of R100 or more per year are eligible for a tax receipt.

8. USE OF OUR SITE FROM OUTSIDE OF SOUTH AFRICA

8.1. Whilst we welcome all visitors to this site, we cannot guarantee that the website is appropriate or available for use in any territory. Those who visit the website from outside South Africa are responsible for complying with all applicable laws.

9. GENERAL TERMS

9.2. amandla.mobi is committed to providing a safe and respectful working environment for all our staff. This means we reserve the right to close your account, petition, or your partnership if you are disrespectful, abusive or threatening to a member of the amandla.mobi staff team. This includes, but is not limited to, behaviour such as shouting, posting on personal social media accounts, making threats, harassing or attempting to bribe, guilt or coerce our staff team into putting your campaign ahead of amandla.mobi members priorities.

9.2. amandla.mobi reserves the right to change any or all of these terms of service and/or add new terms of service at any time. When we do so, we will make a new copy of these Terms of Service available on our website. You are expected to check this page frequently to take note of any changes we make. Your continued use of our website will be deemed to constitute your acceptance of such changes. 

9.3. You must not publish or use any part of the materials on the amandla for commercial purposes.mobi website or the organisation’s mobile channels without obtaining our written consent.

9.4. If you are aware of any breach of these Terms of Service or other misuse of the amandla.mobi website and/or mobile channels, please notify the team by writing to hola@amandla.mobi

9.5. These Terms of Service set out the entire agreement between you and us regarding your use of our website and supersede all prior discussions and communications.

9.6. There is no relationship of employment, partnership, agency or fiduciaries between you and us.

9.7. These Terms of Service shall be governed and construed in accordance with the laws of South Africa, and any disputes relating to these shall be subject to the exclusive jurisdiction of the courts of the country.
